These Terms and Conditions (hereinafter, the "Terms") govern access to and use of the platform analiticalata.com (hereinafter, the "Platform"), operated by Analiticalata S.A.S., a company incorporated under the laws of the Republic of Colombia, with NIT 901.456.789-3, domiciled at Carrera 11 No. 93-52, Office 401, Torre Pacífico Building, Bogotá D.C., Colombia.
1. Purpose of the platform
Analiticalata is a real estate crowdfunding platform that facilitates connections between investors and promoters of construction and real estate development projects in Colombia. The Platform acts exclusively as a technological intermediary and not as an investment advisor, builder, or financial institution.
2. Participation requirements
To use the Platform's services, the user must: • Be of legal age under Colombian law (18 years of age). • Provide truthful, complete, and up-to-date information during the registration process. • Not be legally disqualified from entering into legal acts. • Comply with anti-money laundering and counter-terrorism financing provisions established by Colombian regulations.
3. Nature of investments
Investments made through the Platform carry inherent risks typical of the real estate sector and the crowdfunding model. Analiticalata does not guarantee fixed returns or full recovery of invested capital. Each published project includes detailed information about specific risks that the investor must evaluate before making any investment decision.
4. Analiticalata's responsibilities
Analiticalata commits to: • Conducting a preliminary evaluation of projects published on the Platform. • Providing clear and up-to-date information about each investment opportunity. • Protecting users' personal data in accordance with the Privacy Policy and current legislation. • Maintaining the Platform operational and secure, implementing reasonable technological protection measures. Analiticalata is not responsible for: • Investment decisions made by users. • Delays, cost overruns, or defaults by project promoters. • Losses resulting from real estate market fluctuations.
5. Intellectual property
All Platform content — including texts, graphics, logos, trademarks, software, and databases — is the property of Analiticalata S.A.S. or its respective owners and is protected by Colombian and international intellectual property law. Reproduction, distribution, or unauthorized use of any content without prior written consent is prohibited.
6. Applicable law and jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any disputes arising from the use of the Platform shall be submitted to the jurisdiction of the competent courts of Bogotá D.C., Colombia, unless a mandatory legal provision states otherwise.
7. Risk disclosure
Real estate crowdfunding is an activity that carries risks of partial or total loss of invested capital. Past returns do not guarantee future results. Before investing, carefully evaluate your personal financial situation and, if deemed necessary, consult with an independent financial advisor. Analiticalata does not offer financial, tax, or legal advice.
8. Modifications
Analiticalata reserves the right to modify these Terms at any time. Modifications will take effect upon their publication on the Platform. Continued use of the services after the publication of changes constitutes acceptance thereof.
